By accessing or using SimSights Golf ("Service"), operated by SimSights Golf ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
SimSights Golf is a golf analytics platform that helps golfers analyze their launch monitor data. The Service includes:
- Screenshot and image analysis via OCR (optical character recognition)
- CSV/Excel file upload for bulk data import
- AI-powered shot analysis and insights
- Goal tracking and progress monitoring
- Personalized practice drill recommendations
- SMS-based shot analysis (text a screenshot to receive analysis)
3. SMS Terms and Conditions
By texting screenshots to our SMS number or providing your phone number on our website, you agree to the following SMS-specific terms:
3.1 Consent to Receive Messages
By texting our number or adding your phone number to your account, you expressly consent to receive SMS messages from SimSights Golf. These messages are transactional in nature and may include:
- Shot analysis results in response to screenshots you send
- Phone verification codes
- Account registration links
- Account-related notifications
3.2 Message Frequency
Message frequency varies based on your usage. Typically, you will receive 1-3 messages per interaction (e.g., one analysis response per screenshot sent). We do not send marketing or promotional SMS messages.
3.3 Message and Data Rates
Message and data rates may apply. Please consult your wireless carrier for details about your messaging plan.
3.4 Opting Out
You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and no further messages will be sent unless you re-initiate contact. You may also reply HELP at any time to receive assistance information.
3.5 Carriers Supported
Our SMS service is supported by major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier delivery is not guaranteed. Messages may be delayed or undelivered due to carrier issues.
4. User Accounts
You may use certain features of the Service (such as SMS shot analysis) without creating an account. To save your data and access full features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious content or attempt to compromise the Service
- Interfere with other users' use of the Service
- Attempt to reverse engineer or extract source code
- Use automated systems to access the Service without permission
- Send spam or unsolicited messages through our SMS system
6. Intellectual Property
The Service, including its design, features, and content (excluding user-submitted data), is owned by SimSights Golf and protected by intellectual property laws. You retain ownership of your golf shot data but grant us a license to process and analyze it to provide the Service.
7. AI-Generated Content
Our analysis and recommendations are generated using artificial intelligence. While we strive for accuracy, AI-generated insights are provided for informational purposes only and should not be considered professional golf instruction. We make no guarantees about the accuracy or effectiveness of any recommendations.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMSIGHTS GOLF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
10. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time through your profile settings.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
